1. Acceptance of Terms
By accessing or using any product, application, or service made available by LA BOMBA.dev ("we", "us", "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please stop using our services immediately.
2. Who We Are
LA BOMBA.dev is an independent software studio. Our products are web applications, browser extensions, and third-party platform integrations (including apps distributed through platforms such as Canva). Our support contact is hello@labomba.dev.
3. Changes to These Terms
We may update these Terms at any time. We will indicate the "Last updated" date above. Continued use of our services after any change constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users (e.g. via in-app notice or email where we hold your address).
4. Eligibility
You must be at least 13 years old to use our services (or the minimum age of digital consent in your jurisdiction, whichever is higher). By using our services you represent that you meet this requirement. If you are under 18, you must have parental or guardian consent.
5. Licence to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use our services for your personal or internal business purposes. You may not:
- Copy, modify, distribute, sell, or lease any part of our services or software
- Reverse engineer or attempt to extract source code
- Use our services to build a competing product
- Use automated tools (scrapers, bots, crawlers) against our services in a way that exceeds normal use
6. User Accounts
Some of our products require you to authenticate via a third-party platform (e.g. Canva, Google). You are responsible for maintaining the security of your credentials on those platforms. We are not liable for any loss arising from unauthorised access to your third-party account.
7. Acceptable Use
You agree not to use our services to:
- Violate any applicable law or regulation
- Infringe the intellectual property rights of any third party
- Transmit harmful, offensive, or unlawful content
- Interfere with or disrupt the integrity or performance of our services
- Attempt to gain unauthorised access to any system or data
We reserve the right to suspend or terminate access for any user who violates this section.
8. Third-Party Services and Content
Our products may integrate with third-party platforms and APIs (including but not limited to Spotify and Canva). Your use of those third-party services is governed by their own terms and policies. We are not responsible for the availability, accuracy, or content of third-party services.
Content retrieved from third-party APIs (such as track titles, artwork, and descriptions) remains the property of the respective rights holders. We do not claim ownership of any such content.
9. Intellectual Property
All original code, design, branding, and documentation produced by LA BOMBA.dev is our intellectual property. "LA BOMBA.dev" and any associated logos are our trademarks. Nothing in these Terms grants you any rights to our intellectual property beyond the limited licence in Section 5.
10. Disclaimers
Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- Our services will be uninterrupted or error-free
- Any content or data obtained through our services will be accurate or reliable
- Defects will be corrected
11. Product-Specific Terms
11.1 Music Embed (Canva App)
Music Embed is a Canva application that allows users to search Spotify content and embed Spotify players into Canva designs.
- Spotify content. All music content is sourced from the Spotify Web API and is subject to Spotify's Terms of Service. We do not host, cache, or redistribute any audio streams.
- Embeds. Embedded Spotify players are standard Spotify embed widgets. Playback within those widgets is governed by Spotify's terms and requires a Spotify account for full functionality.
- No affiliation. Music Embed is an independent integration and is not affiliated with, endorsed by, or sponsored by Spotify AB.
- Canva platform. Your use of Music Embed within Canva is also subject to Canva's Terms of Use.
- Rate limits. Music Embed operates under Spotify's API rate limits. During periods of high demand, search functionality may be temporarily unavailable.
12. Limitation of Liability
To the maximum extent permitted by applicable law, LA BOMBA.dev and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use our services.
Our total aggregate liability for any claim related to our services shall not exceed the amount you paid us in the twelve months preceding the claim (or €20 if you have not made any payment).
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
13. Governing Law and Disputes
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles.
For users in the European Union: nothing in these Terms affects your rights as a consumer under applicable EU law, including the right to bring proceedings in the courts of your country of residence.
Any dispute that cannot be resolved informally (by contacting hello@labomba.dev) shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, except where mandatory consumer protection law provides otherwise.
14. Termination
We may suspend or terminate your access to our services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. You may stop using our services at any time.
On termination, all licences granted to you under these Terms cease immediately.
15. General
- Entire agreement. These Terms (together with our Privacy Policy) constitute the entire agreement between you and LA BOMBA.dev regarding our services.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
- Waiver. Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
- Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign ours freely.
